Terms of Service
The agreement between you and 98%Chimp Inc. ("Argus") for use of the Argus platform and this site.

1. Acceptance
By accessing or using Argus, you agree to these Terms and to our Privacy Policy. If you are using Argus on behalf of an organisation, you represent that you have authority to bind that organisation.
2. The service
Argus is a multi-tenant feature-flag control plane: per-tenant flag resolution, a two-engineer approval workflow, an immutable per-tenant audit log, and SDKs/endpoints for clients to resolve flags. The service is provided during its current pre-launch and pilot phase on an evolving basis; features and roadmap items may change.
3. Pilot terms
If you participate in a design-partner pilot, the pilot scope, duration, and pricing are set out in your pilot agreement and prevail over these Terms where they conflict. Pilot pricing is fixed and disclosed before you commit. Either party may end a pilot with reasonable written notice.
4. Accounts & access
You are responsible for your account credentials, your apiKeys, and the actions taken under your account. Keep apiKeys and service-account keys confidential; rotate them in Argus if they are exposed.
5. Acceptable use
Do not use Argus to violate law, infringe rights, attempt to breach the access controls of other tenants or customers, or disrupt the service (e.g. exceeding documented rate limits to degrade availability). We may suspend access to protect the service or other customers.
6. Your data & intellectual property
You retain ownership of the workspace data you put into Argus. You grant us the limited rights needed to host and process it to provide the service. We retain ownership of the Argus software, brand, and documentation. Feedback you share may be used to improve the service.
7. Availability
During pre-launch the service is provided without an uptime commitment. Service-level commitments, where offered, are stated in the applicable plan or order (e.g. the Growth tier's published SLA).
8. Disclaimers
Except as expressly stated, Argus is provided "as is" without warranties of any kind, to the maximum extent permitted by law. You are responsible for validating flag behaviour in your own environments before relying on it in production.
9. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, or consequential damages, and Argus's total liability arising from the service is limited to the fees paid for it in the twelve months preceding the claim (or, during a free pilot, a nominal amount).
10. Termination
You may stop using Argus at any time. We may suspend or terminate access for breach of these Terms or to comply with law. On termination you may request export of your data for a reasonable period before deletion.
11. Governing law
These Terms are governed by the laws of Canada and the applicable province in which 98%Chimp Inc. is established, without regard to conflict-of-laws rules.
